Does A Gun Ban Violate The 2nd Amendment?
Depends on what kind of gun is being banned. The 2nd Amendment, as defined by the District of Columbia v. Heller decision in 2008, extends Constitutional protection, "then as now, to weapons that were not specifically designed for military use and were not employed in a military capacity."
The guns that we want to ban were all designed and are currently issued to U.S. troops and allied armies throughout the globe.
